"We are trying to find a solution with Fifa and believe we have a good case to appeal for the transfer to go ahead," said Benitez. Liverpool have challenged the current laws after coming to an arrangement with The Hammers for the transfer of the former Corinthians man. However, if the deal is not concluded by the close of the transfer window, then Curbishley insists the unsettled midfielder could still have a role to play at Upton Park. "There is a ruling that is quite clear that it can't really happen," said Curbishley. "It is out of our hands at the moment. "I have inherited a very difficult situation. It happened before I got here and Eggert (Magnusson, the new chairman) got here. "We have allowed this situation to arise because he has not been playing. I have looked at my team selections and he hasn't featured in it. "I felt that if there was an opportunity for him in this window we would allow him to go. If it doesn't happen he is a West Ham player. I have not dismissed him at all." The Hammers boss has been working hard to strengthen his squad due to the club's perilous league position, with Luis Boa Morte, Nigel Quashie and Calum Davenport already recruited. Lucas Neill is expected to follow and Curbishley insists a substantial outlay is required if West Ham are to beat the drop. "It has been a real hectic time.
