Fifa is scrutinising the possibility of Javier Mascherano joining Liverpool after the Reds challenged the governing body's assessment that the move would breach their rule banning a player from playing for three clubs in a season."We have received correspondence from Liverpool regarding their proposed signing of Mascherano and a case has been opened," said a spokesman. The Reds are understood to have agreed a deal for the Argentinian international, with the only remaining sticking point being the fact that he has already played for both The Hammers and Corinthians this season. Fifa regulations prohibit any player from appearing for three separate teams between 1st July and 30th June, but Liverpool have petitioned the game's governing body to see if they can challenge the current rules. The Reds are believed to be arguing from the perspective that Mascherano has played just six minutes of football since October after failing to make an impression under either Alan Curbishley or his predecessor Alan Pardew. Benitez insists he is still hopeful that The Reds can succeed in winning a landmark judgement in a similar vein to the Bosman ruling which enabled freedom of movement for players out of contract in 1995. "We are trying to find a solution with Fifa and believe we have a good case to appeal for the transfer to go ahead," said Benitez. "People say we can't do this deal, but why are there so many other examples? "I know of one player who played for four clubs in a year. "There needs to be a solution and I still have confidence the player can join us. There are rules in football, but they are not laws that can't be challenged. "The Bosman case proved that." If Liverpool are successful then any judgement could have far-reaching consequences for the transfer market as a whole. The Argentinian international's club future currently hinges on whether Fifa will allow The Reds to take him to Anfield despite regulations preventing any player from appearing for three clubs in the period from 1st July to 30th June. Liverpool have challenged the current laws after coming to an arrangement with The Hammers for the transfer of the former Corinthians man. However, if the deal is not concluded by the close of the transfer window, then Curbishley insists the unsettled midfielder could still have a role to play at Upton Park. "There is a ruling that is quite clear that it can't really happen," said Curbishley. "It is out of our hands at the moment. "I have inherited a very difficult situation. It happened before I got here and Eggert (Magnusson, the new chairman) got here. "We have allowed this situation to arise because he has not been playing. I have looked at my team selections and he hasn't featured in it. "I felt that if there was an opportunity for him in this window we would allow him to go. If it doesn't happen he is a West Ham player. I have not dismissed him at all." The Hammers boss has been working hard to strengthen his squad due to the club's perilous league position, with Luis Boa Morte, Nigel Quashie and Calum Davenport already recruited. Lucas Neill is expected to follow and Curbishley insists a substantial outlay is required if West Ham are to beat the drop. "It has been a real hectic time. Every day has been full on," Curbishley admitted. "The chairman is backing everything we are trying to do. The people in charge have the right intentions and there is no thought about going down. "It is all geared to being in the Premiership next year. I am under no pressure to let people go. It is all about strengthening. "This is the most money I have ever spent in one season. It is the situation we find ourselves in."
